Overgrown Vegetation

Property owners and occupiers are responsible for the maintenance of their properties, including the footpath area.

Council is empowered under the provisions of the Local Government Act 1993 to preserve public health and safety in their local community, including overgrown vegetation on private property.

When is a property overgrown?
A property is classified overgrown (and poses a threat to public health and safety) when the grass is approximately 500mm in height.

What action will Council take?
A Council Environmental Health Officer will inspect the property to determine if the conditions present pose a threat to public health and safety ie because of the length of grass, presence of vermin and/or rodents and the like.

If it is determined that the property is overgrown, correspondence will be sent to the owner and/or occupier of the property requiring action to be taken to rectify the situation. Most cases are resolved amicably at this stage of action.

If however further action is required, Council will take action under Section 124 of the Local Government Act 1993, which may result in legal action being instituted for non-compliance.

Penalties
Penalties range from an 'on-the-spot' fine of $330 being issued, $2,200 if action is pursued through the local court or Council carrying out the work and recovering costs from the owner of the property.

How do I report an overgrown property?
Telephone your local Environmental Health Officer on 9806 5000, in person at Level 3, 30 Darcy Street, Parramatta or e-mail Council at council@parracity.nsw.gov.au.

Your name and address will be requested, together with the address of the property concerned and a description of the conditions.
