Overgrown VegetationProperty owners and occupiers are responsible for the maintenance of their properties, including the footpath area. Council is empowered under the provisions of the Local Government Act 1993 to preserve public health and safety in their local community, including overgrown vegetation on private property.
When is a property overgrown?
What action will Council take? If it is determined that the property is overgrown, correspondence will be sent to the owner and/or occupier of the property requiring action to be taken to rectify the situation. Most cases are resolved amicably at this stage of action. If however further action is required, Council will take action under Section 124 of the Local Government Act 1993, which may result in legal action being instituted for non-compliance.
Penalties
